Court of Appeal has sacked Sen. Dayo Adeyeye of the All Progressive Congress (APC) and declared Senator Biodun Olujimi of the People Democratic Party (PDP) winner of the 2019 Ekiti South Senatorial Election.
Before this ruling, Senator Dayo was the spoke person for the 9th Senate and represents Ekiti South Senatorial District.
The Justice Uzor Anyanwu led Court of Appeal sitting in Kaduna delivered the ruling on Wednesday, 6 November 2019.
After the Independent National Electoral Commission (INEC) announced Senator Dayo the winner of the February 23 election, Senator Olujimi headed to the Elections Petitions Tribunal, saying she has the highest votes in the election.
The Tribunal then nullified the victory of Senator Dayo and declared the PDP candidate winner of the election. The court also ordered INEC to withdraw the certificate of return from Senator Dayo and issue it to Senator Olujimi.
Consequently, Senator Dayo approached the Appeal court seeking that the court should overturn the Tribunal’s verdict. However, the Appeal Court affirmed the Tribunal’s ruling and ordered that the certificate of return be issued to the PDP candidate.
As it stands, the APC man has only one hope of maintaining his seat in the upper chamber that is the Supreme court. So, it is not Victory at last for now.
